At The Emily Pepper, we are committed to protecting our intellectual property, likeness, and reputation across all platforms, including social media. This Intellectual Property and Social Media Policy outlines the rules governing the use, reproduction, and discussion of The Emily Pepper, its entities, and related initiatives. It also defines acceptable engagement on social media platforms.

This policy complies with all applicable Canadian and U.S. laws and operates in tandem with all other policies of The Emily Pepper, including the Class Action Disclaimer and Privacy Policy.

This policy applies to all individuals, entities, platforms, and organizations worldwide, including but not limited to:

  • Social media users and platforms.
  • News organizations and media outlets.
  • Individuals or entities reproducing, sharing, or commenting on content related to The Emily Pepper.

  1. Ownership of Intellectual Property and Likeness

2.1 Intellectual Property: All content, materials, trademarks, logos, designs, text, images, videos, and other intellectual property (collectively, β€œIP”) associated with The Emily Pepper are exclusively owned by The Emily Pepper.

2.2 Likeness and Personal Image: The name, image, voice, likeness, and persona of The Emily Pepper are strictly protected under applicable intellectual property and personality rights laws in Canada, the U.S., and globally.

2.3 Global Protection: The protections in this policy extend globally, and violations are subject to enforcement under international intellectual property treaties, including the Berne Convention and the Madrid Protocol.

3.1 Respectful Interaction: Users must engage respectfully when discussing or interacting with content related to The Emily Pepper on social media platforms.

3.2 Prohibited Actions: Without the prior, explicit, written consent of The Emily Pepper, the following actions are strictly prohibited:

  • Sharing or publishing any unauthorized content, including text, images, videos, or designs related to The Emily Pepper.
  • Using or portraying the name, image, voice, or likeness of The Emily Pepper for any purpose, including commentary, reporting, parody, or satire.
  • Posting defamatory, false, or misleading statements about The Emily Pepper or its initiatives.
  • Engaging in hate speech, harassment, or derogatory commentary targeting The Emily Pepper or its affiliates.

3.3 Content Tagging and Referencing: Tags, hashtags, or references associating content with The Emily Pepper without authorization are strictly prohibited.

3.4 Hate Speech and Misinformation: The dissemination of hate speech, misinformation, or content intended to harm the reputation of The Emily Pepper is a violation of this policy.

  1. Enforcement and Consequences

4.1 Legal Action: Violations of this policy will be pursued to the fullest extent of the law, including:

  • Filing civil lawsuits for intellectual property infringement, defamation (libel or slander), or misappropriation of likeness.
  • Seeking injunctive relief to compel the removal of unauthorized content and prevent further violations.

4.2 Damages and Penalties: Violators may be held liable for:

  • Statutory damages under applicable intellectual property or defamation laws.
  • Punitive damages for willful violations, reputational harm, or defamatory statements.
  • Legal fees and court costs incurred by The Emily Pepper.

4.3 Platform Enforcement: Requests will be submitted to third-party platforms to remove unauthorized or harmful content and, where applicable, suspend violators.

4.4 International Enforcement: Enforcement actions may extend globally, subject to international laws and treaties.

If you encounter behavior or content that violates this policy, you are required to report it to The Emily Pepper immediately. Reports can be sent to hello@theemilypepper.com and should include:

  • A description of the violation.
  • Relevant links, screenshots, or evidence.
  1. Limited Exceptions

This policy is absolute in its restrictions on unauthorized use of intellectual property, likeness, and narrative. However, lawful free speech, as protected by the Charter of Rights and Freedoms (Section 2) in Canada and the First Amendment of the U.S. Constitution, is not impeded.

We may update this policy periodically to reflect changes in laws, practices, or operational requirements. Updates will be effective upon posting with a revised "Effective Date."
